SwimStream Pro

These terms outline how SwimStream Pro is intended to be used by schools, clubs, and community organisations.

1. Acceptance of Terms

By accessing or using SwimStream Pro, you agree to these Terms of Use.

If you are using the platform on behalf of a school, club, or organisation, you confirm that you have authority to do so.

2. Intended Use

SwimStream Pro is designed to assist schools, swim clubs, and community organisations in managing swimming meets, recording event information, and sharing results with authorised participants and spectators.

The platform must be used responsibly and in accordance with relevant privacy, child safety, and organisational policies.

3. User Responsibilities

Users agree to:

  • Upload only information necessary for event operation
  • Ensure appropriate consent exists where required
  • Maintain secure login access where applicable
  • Use the platform for lawful and appropriate purposes

Schools and organisations remain responsible for how they collect participant data prior to upload.

4. Student Data and Privacy

Where student information is uploaded:

  • The school or organisation retains ownership of the data
  • SwimStream Pro acts solely as a service provider
  • Data will not be sold, rented, or used for advertising

5. Data Hosting

Platform data is hosted using secure cloud infrastructure selected for reliability, security, and suitability for educational use.

Hosting providers may change as the platform evolves.

Updated hosting information can be provided to authorised organisations upon request.

6. Availability of Service

We aim to provide reliable access; however:

  • Temporary interruptions may occur due to maintenance or technical factors
  • Continuous, error-free availability cannot be guaranteed
  • Event organisers are encouraged to maintain backup records where appropriate

7. Intellectual Property

All software, branding, design, and platform materials associated with SwimStream Pro remain the intellectual property of the service owner unless otherwise stated.

Users must not:

  • Copy, modify, or redistribute the platform
  • Attempt to reverse engineer the software
  • Use branding without permission

8. Security Commitment

We take reasonable steps to protect stored information through secure hosting environments, encrypted connections, and access controls.

Users also share responsibility for maintaining secure access credentials.

9. Limitation of Liability

To the extent permitted by law:

  • SwimStream Pro is provided “as is”
  • We are not liable for indirect or consequential losses arising from platform use
  • Event organisers remain responsible for operational decisions and supervision

Nothing in these terms excludes rights available under Australian Consumer Law.

10. Termination of Use

Access may be suspended or terminated if:

  • These terms are breached
  • Platform misuse is identified
  • Security concerns arise

We will act reasonably and transparently wherever possible.

11. Updates to Terms

These Terms may be updated periodically as the platform evolves or regulatory expectations change.

Continued use indicates acceptance of any updated Terms.
